The Terms as set out hereunder constitute the entire agreement between you and Tamboerskloof Lodge ('The Backpack and Africa Travel Centre'). If you do not read or accept these Terms, do not use this website. By accessing any part of the The Backpack and Africa Travel Centre website, you consent to be bound by these Terms.

We facilitate confirmed bookings for certain travel services including accommodation. We do not provide, own or run any travel services ourselves and in particular we do not provide, own or run any accommodation.
You may cancel your booking up to twenty-four hours before arrival. Please do so directly with the relevant travel services provider.
DEPOSITS ARE NON REFUNDABLE.
In the event of a no-show without cancellation, we have the right to charge your credit card for the first night's stay where you have booked accommodation with such service provider, or for the full price of the tour or other non-accommodation travel service in accordance with the travel service provider's terms and conditions.
Every effort is made to ensure the travel services provider processes your bookings correctly.
In the highly unlikely event of a problem arising, our liability to you, if any, is limited to the deposit and that reservation fee you paid.
Ratings shown on the website are the opinion of people who have booked and availed of the relevant travel services or have stayed in the relevant accommodation. We take no responsibility for the such opinions.

You should note that The Backpack and Africa Travel Centre does not warrant that the information published on this website will be error free and in using this website you acknowledge that the accommodation details and all other information including information relating to travel services published on this website may include inaccuracies or typographical errors.

All bookings for travel services on this website are made with the travel services provider concerned and not with The Backpack and Africa Travel Centre. The Backpack and Africa Travel Centre only facilitates the making of reservations with the travel services provider. The Backpack and Africa Travel Centre is not a party to the contract between you and the travel services provider and has no responsibility or liability to you in respect of the terms of that contract whether directly or indirectly.

Prior to making a booking, you should ensure that you have reviewed the terms and conditions and that they are acceptable to you.

NEITHER The Backpack and Africa Travel Centre NOR ANY OF ITS DIRECTORS, EMPLOYEES, AFFILIATES OR OTHER REPRESENTATIVES WILL BE LIABLE FOR LOSS OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ANY INFORMATION, PRODUCTS, SERVICES AND/OR THE MATERIALS OFFERED THROUGH THIS WEBSITE, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, INCOME, PROFIT OR OPPORTUNITY, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES, OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGES, EVEN IF The Backpack and Africa Travel Centre HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, OR SUCH LOSS OR DAMAGES WERE REASONABLY FORESEEABLE.

While The Backpack and Africa Travel Centre makes all reasonable efforts to ensure that the travel services listed are of reasonable standard the listing of any travel services in the website is not and should not be taken as a recommendation from The Backpack and Africa Travel Centre or a representation that the travel services will be suitable for the user's purpose.

The Backpack and Africa Travel Centre shall in no way be liable to you in the event that the travel services are not suitable for your purpose.

NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of this website, you undertake to The Backpack and Africa Travel Centre that you will not use this website for any purpose that is unlawful or prohibited by these Terms.

AGE AND RESPONSIBILITY

You understand that you are financially responsible for all uses of this website by you and those using your log-in information.

Refund and Return Policy

NOTE: Special Events Booking FIFA World Cup 2010 - *FIFA WORLD CUP CONDITIONS Due to a very high demand during the FIFA World Cup 2010 period the following terms and conditions apply. Failure to comply with these terms and conditions will result in booking being cancelled. *Guests must book in for a minimum of 3 consecutive nights. *The balance due must be paid within 7 days after booking is made on-line in order to secure the booking. You will be contacted with the details on how full payment can be made. *Full non refundable payment will then be taken and the booking will be confirmed. *Breakfast (set menu) is included in these rates from 8^th June 2010 to 31 July 2010.

The provision of goods and services is subject to availability. In cases of unavailability, the provider will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10% charge for administration costs.

The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

Updating of these Terms and Conditions

Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

The following conditions apply to bookings of travel services made by you through this website.

(1) Making a reservation
On making a reservation, you shall pay a non-refundable deposit (being a fixed percentage -- USUALLY 10% or 15% -- of the total value of your reservation. You will be responsible to the The Backpack & Africa Travel Centre for payment of the balance of the cost of the travel services booked by you together with the payment of charges for any additional services subsequently contracted for with the travel services provider and, where applicable, payment of the The Backpack and Africa Travel Centreservice charges and taxes pursuant to the terms and conditions of trade applied by such travel services provider.

You must use a credit card or debit card to guarantee a reservation. By making a reservation with your credit card or debit card, you agree that in the event that you cancel your reservation less than 24 hours from your agreed check-in time or that you fail to arrive by your agreed check-in time, you authorise the travel services provider to charge to your credit card or debit card without further reference to you an amount not exceeding one night's charge in the case of accommodation or such amount as may be set out in the service provider's terms and conditions in the case of non-accommodation product. Your non-arrival by the agreed check in time will result in the cancellation of your entire reservation.

Any amendments to your reservation must be notified to and agreed with the travel services provider directly.

In making a reservation, it shall be your responsibility to disclose to the travel services provider any physical or mental condition to which you or a member of your party is subject to and of which the travel services provider should be notified and which may require special facilities.

(2) When a reservation is confirmed
The Backpack and Africa Travel Centre will issue the booking confirmation on behalf of the travel services provider for each reservation, but does not undertake to include charges for additional services or details of the service charge or taxes charged by the travel services provider.

The Backpack and Africa Travel Centre strongly recommends you check and confirm with the travel services provider the precise terms and conditions upon which the travel services provider makes the reserved service available to you upon receipt of the booking confirmation. The reservation numbers included on the booking confirmation should be quoted in all enquiries, cancellation or modification of the reservation.

(3) Cancellations
The Backpack and Africa Travel Centre does not accept responsibility for cancellations by you or by the travel services provider regardless of the circumstances in which the cancellation is made.

The Backpack and Africa Travel Centre shall not accept any liability for losses, additional expenses or any claim whatsoever due to changes in accommodation or other travel services, sickness, weather, strikes or any other cause. All such losses, additional expenses or claims will be borne by you unless otherwise agreed between you and the service provider.

NO LIABILITY IN CREDIT CARD OR DEBIT CARD TRANSACTIONS
The Backpack and Africa Travel Centre makes all reasonable efforts to ensure that all credit card and debit card transactions are secure. HOWEVER, if unauthorised charges appear on your credit card or debit card statement for any card used on this website at any time during or after you make your reservation, conduct your transaction or disclose your card details on this website, The Backpack and Africa Travel Centre shall not be liable or responsible in any way in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with said use, transaction or disclosure, subject only to any statutory rights which you may have.

You hereby consent to the exclusive jurisdiction of the Republic of Ireland courts in all disputes arising out of or relating to the use of this website each time you access the website.
